2. Acceptance of These Terms

By creating an account, accessing AdvisHR, submitting a booking or making a payment, you agree to these Terms. If you do not agree with these Terms, you must not use AdvisHR or purchase services through the platform.

3. User Accounts

Certain AdvisHR functionality requires an account. Users are responsible for providing accurate and current information; maintaining the confidentiality of login credentials; preventing unauthorised access; notifying AdvisHR if they suspect unauthorised access; and ensuring information submitted through their account is accurate.

4. Bookings

4.1 Booking Requests

A booking submitted through AdvisHR constitutes a request for services and does not constitute confirmation until AdvisHR or an authorised service provider confirms the booking.

4.2 Availability

AdvisHR does not guarantee the availability of a particular chairperson, initiator, consultant or other service provider. Where the requested service provider or time is unavailable, AdvisHR may offer an alternative.

4.3 Booking Information

Users are responsible for providing accurate and complete information necessary for the requested service.

5. Employment-Relations Services

AdvisHR provides access to employment-relations and labour-relations services. The provision of an AdvisHR service does not constitute legal advice or legal representation. Users remain responsible for obtaining independent legal advice where appropriate. AdvisHR does not make employment decisions on behalf of employers.

6. Disciplinary Hearings and Employment Outcomes

6.1 No Guaranteed Outcome

AdvisHR does not guarantee any particular outcome from a disciplinary hearing, grievance, suspension process or other employment-relations matter.

6.2 CCMA and Other Proceedings

An employer may follow a disciplinary procedure and nevertheless face a subsequent referral to the CCMA, bargaining council, Labour Court or another forum. AdvisHR does not control the decisions, findings or outcomes of such external bodies.

6.3 Employer Responsibility

The employer remains responsible for its employment decisions, instructions, information and evidence, preparation, compliance with applicable employment legislation, obtaining legal advice where appropriate, and responding to subsequent proceedings.

7. Independent Service Providers

Where a service is performed by an independent chairperson, initiator, consultant or other service provider, that service provider may exercise independent professional judgment. AdvisHR does not guarantee the professional conclusions, findings or decisions of an independent service provider.

8. Documents and Hearing Outcomes

Users may upload documents, evidence and other information through AdvisHR. Users confirm that they have the necessary authority to provide information and documents that they upload. Users remain responsible for ensuring that documents supplied are accurate, relevant and lawfully provided.

9. Payments

Payments for AdvisHR services are processed through third-party payment providers, including PayFast. AdvisHR does not intentionally store users' complete payment-card numbers, card security codes or online banking passwords.

10. Cancellations and Refunds

10.1 General Refund Policy

AdvisHR's general policy is that payments for confirmed services are non-refundable, subject to any refund, cancellation or other rights that cannot lawfully be excluded under applicable South African law.

10.2 Cancellation

Users may request cancellation of a booking. Where applicable law permits a cancellation charge, AdvisHR may apply a reasonable cancellation charge having regard to the nature of the service, the notice provided and the circumstances.

10.3 Services Already Performed

Where a service has already commenced or been completed, no refund will ordinarily be provided, subject to any rights the user may have under applicable law.

11. Important Liability Limitation

To the maximum extent permitted by applicable South African law, AdvisHR is not responsible for losses, claims or consequences arising from decisions made by an employer or employee; information or evidence supplied by a user; incomplete or inaccurate information; an employer's failure to properly prepare for a hearing; failure to obtain appropriate legal advice; the outcome of a disciplinary hearing; a dismissal, suspension, warning or other employment decision; CCMA or bargaining council proceedings; Labour Court or Labour Appeal Court proceedings; decisions made by external decision-makers; evidence that was unavailable, withheld or not provided; actions or omissions of third parties; events occurring after an AdvisHR service; or interruptions caused by third-party providers outside AdvisHR's reasonable control. Nothing in this section excludes or limits liability where prohibited by applicable law.

12. Technical Availability

AdvisHR aims to provide reliable access to its platform but does not guarantee uninterrupted or error-free availability. The platform may temporarily become unavailable because of maintenance, software updates, hosting failures, network failures, third-party service interruptions, security incidents, technical problems or circumstances outside AdvisHR's reasonable control.

13. Third-Party Services

AdvisHR may use third-party providers to operate certain functionality, including PayFast, cloud hosting and storage providers, notification services and other technology providers.

14. User Responsibilities

Users must not use AdvisHR for unlawful purposes; provide fraudulent or misleading information; impersonate another person; upload malicious software or unlawful material; access another person's account without permission; interfere with the operation or security of AdvisHR; misuse personal information belonging to another person; or use AdvisHR in breach of applicable law.
